The sale and purchase agreement for an apartment, house or commercial premises in Moldova is signed before a notary. The buyer becomes the owner once the transfer of ownership is registered in the Real Estate Register; the notary can submit the registration application online. The Register is maintained by the territorial offices of the public institution “Real Estate Cadastre”.
Before the transaction, it is advisable to obtain a recent extract from the Register and check the owner, cadastral number, mortgage, attachments and any other registered rights. Ask the seller for proof of ownership, the cadastral plan and, if the property is jointly owned, the consent of the spouse or other co-owners. For a house, also check the rights to the plot, its category and boundaries; for a new-build, check the permits and whether the building has been completed. The notary verifies the parties’ identities and documents and may request information about the source of the funds.
Foreign nationals can buy apartments, houses and commercial property. The restriction applies to agricultural land and forest land: under the Land Code, these cannot be acquired by foreign nationals or companies, or by companies with foreign capital. If a foreign national inherits such land, it must be sold within one year.
